Terms of Service
Last Updated: 28th June 2025
These terms explain what Hello Atithi offers, how the access works, and what to expect while using the service. By using Hello Atithi, you agree to the conditions below.
1. Introduction
Hello Atithi is a digital service crafted for international travelers who are visiting India for leisure and recreational purpose (e.g., on tourist visa). It is designed to step in when systems break, plans collapse, or access is blocked. It addresses breakdown points such as visa confusion, local verification gaps, transport disruption, or fraudulent practices.
2. Eligibility
Use of Hello Atithi is limited to:
• Individuals above 18 years of age (or legal age in the country of residence)
• Travelers visiting India on valid short-term visas (e.g., tourist, business)
• Users who are not using the service for reselling or commercial operations
Access must be purchased by the user or a verified representative and is non-transferable unless explicitly stated in the Duo or Friends access models.
3. Description of Services
Hello Atithi offers a suite of digitally-enabled travel services, categorized under:
a. Pre-Trip:
• Visa and permit clarity and redirection to correct channels
• Help navigating India-only travel platforms that block foreign users
• Validation of agents, itineraries proposals, or traditional service providers
• Detect inflated charges, disguised upsells, or tourist-specific markups
• Assistance in making local service payments (where remote guidance suffices)
b. On-Ground:
• Rerouting in case of missed trains, buses, or connection delays
• Structured clarity on how India's transport systems (bus, rail, regional) function
• Price checks before making large or irreversible purchases (e.g., Costly Souvenir)
• Step-in actions during system-level disruptions, theft, health issues, or location-based friction
• Communication and action workflows triggered when local interactions become ambiguous or break down
All services are advisory, non-binding, and intervention-based. The user remains in control and responsible for final actions or decisions.
4. Activation & Access
Access begins immediately upon payment and extends until the end of declared travel days in India. Users provide trip duration during checkout to calculate access fees. There are no user dashboards, passwords, or apps. Connection is established via WhatsApp or similar direct communication channels. Hello Atithi remains non-intrusive and responds only when activated by the user or when it detects a failure scenario in real time.
5. Payments & Refund Policy
Hello Atithi charges a flat per-day access fee (e.g., $5/day), billed once at checkout. The access price is inclusive of all taxes and service fees. Refunds are generally processed within 7 days and considered only under the following conditions:
• The user cancels before the start of any of above mentioned services (in point 3).
• Hello Atithi fails to activate service after confirmed payment.
• Partial refunds are not provided if service is partially used.
Payment processing is handled through secure third-party gateways (e.g., PayPal). Hello Atithi does not store or handle payment details directly.
6. Communication Terms
Hello Atithi communicates primarily through text-based platforms such as WhatsApp, email, or similar direct channels. Service may include audio calls when needed, but the default mode remains message-based to ensure clarity and recordkeeping. Hello Atithi does not send promotional messages, spam, or marketing nudges. Users are expected to communicate respectfully and within the scope of service. Inappropriate behavior, excessive abuse of service, or off-scope usage may lead to access restriction or termination without refund.
7. Use Restrictions
The following uses of Hello Atithi are strictly prohibited:
• Reselling access to others not covered under the declared Solo, Duo, or Friends access type.
• Impersonating another traveler or misleading the support team.
• Using Hello Atithi to demand services beyond its scope.
• Attempting to misuse or extract proprietary methods, contacts, or internal processes from the team.
Violation of these terms may lead to immediate suspension without refund.
8. Limitation of Liability
Hello Atithi operates on a reactive intervention model. The goal is to offer accurate input and real-time enablement during points of friction. However:
• Hello Atithi is not responsible for errors or delays caused by third-party systems (e.g., Indian Railways, payment platforms, government websites).
• It cannot be held liable for financial loss due to poor decisions made.
• Delays in response due to network failure, time zone misalignment, or technical disruption.
The user is ultimately responsible for all actions taken before or during the trip, including any outcomes resulting from disregarded input. Hello Atithi acts as a situational infrastructure—not an executing body.
9. Disclaimers
Hello Atithi is not affiliated with any government department, travel agency, transport body, or private operator. The service is not a substitute for emergency services, consular help, or licensed legal advice. All engagement is based on practical input, local systems knowledge, and contextual decoding. It does not guarantee legal protection or specific outcomes. Use of Hello Atithi is voluntary and transactional. Users choose to engage with full awareness of the non-binding nature of all interventions.
10. Termination of Service
Access to Hello Atithi may be terminated under the following circumstances:
• Confirmed misuse, misrepresentation, or abusive behavior
• Completion of the travel duration declared at time of access activation
• Discovery of falsified travel data, identity, or intent
Termination based on user-side violations will not be eligible for refund. In rare cases where Hello Atithi is unable to initiate access despite valid payment, termination may be followed by a full refund.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of India. In case of any dispute, the jurisdiction will lie with courts located in Haridwar, India. Any conflict will first be attempted to resolve through informal negotiation. If unresolved, it shall proceed to binding arbitration or court, as deemed appropriate.
12. Modifications to Terms
Hello Atithi reserves the right to update or change these terms at any time. Users will be notified via email or site update. Continued use of the service implies acceptance of revised terms.
